ESM and the Year 2000 
ESM recognizes the importance of providing our customers with products that will continue to function correctly during the Year 2000 and beyond. ESM has put in place a plan of action to test most of its products for their Year 2000 Compliance as defined in the annex

The testing will determine what, if any, instrument anomalies occur and will generally check if the displayed, printed and logged data are accurate as well if the history files used to make calculations are kept in tact such that the programs execute properly.

September 30, 1998 has been set as the milestone to have all of the listed products and programs tested.

December 31, 1998 has been set as the milestone to have any of the necessary changes complete. It will be standard practice for ESM to ensure that any new products released beyond that date will comply to the Year 2000 requirements. 

ESM Products
It is our goal to ensure that our customers can continue to use our Current Products (as defined in the annex) during and after the Year 2000.

As far as applicable ESM will provide any necessary upgrades at commercially reasonable rates to make non-compliant current Products Year 2000 Compliant or provide the necessary information how the user can navigate non-compliant products through the Year 2000 with the least difficulties. As far as available this information will be provided also for non-compliant Obsolete Products

Attached to this statement is a Product Compliance List, which states the results of our product evaluations to date. We will continue to update this list as our Year 2000 Program proceeds. The current version of our list will be available at our Web site's "NEWS" chapter at www.esm-online.de.

ESM Software
It is important to note that when ESM software is identified as being Year 2000 compliant, we are assuming that you are using compliant hardware and operating systems. The compliance of your ESM products will be subject to the limitations of your computer hardware and operating systems. We performed our evaluations using compliant hardware and operating systems. Since PC's are subject to very rapid changes in firmware and hardware, it is possible that two models that seem to be identical will not handle date functions in exactly the same way. Therefore, if your equipment is used in a critical application, we strongly advise you to test the equipment by simulating the millennium date change yourself. ESM Stand-Alone Products
Certain of our products can be used either on a stand-alone basis or as part of a system. If we have indicated that a product is compliant on a stand-alone basis, you should not assume that it is necessarily compliant when used as part of a system. In our attached Product Compliance List, we have listed stand-alone products. If you are using a stand-alone product as a part of a system or in combination with non standard hard- or software we strongly advise you to test the compliance status of the entire system. On request testing service can be provided at commercially reasonable rates. Third Party Hardware and Software
The Year 2000 compliance status of any hardware, software or firmware not manufactured by ESM is the user's responsibility (they were not included in our evaluation) and the user should contact the manufacturer directly.

The information available from ESM concerning the Year 2000 is provided for the purpose of assisting our customers in their planning for the transition of the Year 2000. 

ESM's Year 2000 Policy statement in no way obligates or makes ESM in any way responsible for any other manufacturer's equipment that ESM's software may be installed on. This includes such items as personal computers, mini computers, or any other computing of other equipment that is provided by other manufacturers. 

Year 2000 compliance for other manufacturer's equipment must be supplied by the particular manufacturer of that equipment. Nothing contained in this statement is intended to modify any rights and obligations which might exist between ESM and a specific customer or to guarantee that any software is error-free.

Annex

DEFINITIONS

Year 2000 Compliant
ESM has adopted the following definition of Year 2000 compliance as set forth by the British Standards Institution in DISC PD2000-1 A Definition of Year 2000 Conformity Requirements (available on the Internet at http://www.bsi.org.uk/disc/year2000/2000.html), with the qualification that the upper limit for compliance is the year 2031.

Year 2000 conformity shall mean that neither performance nor functionality is affected by dates prior to, during, and after the year 2000. 

In particular:
 
Rule 1: No value for current date will cause any interruption in operation.
Rule 2: Date-based functionality must behave consistently for dates prior to, during, and after year 2000
Rule 3: In all interfaces and data storage, the century in any date must be specified explicitly or by unambiguous algorithms or inferencing rules.
Rule 4:  Year 2000 must be recognized as a leap year
